# Recital 24

In the framework of criminal proceedings, the European Production Order and the European Preservation Order should only be issued for specific criminal proceedings concerning a specific criminal offence that has already taken place, after an individual evaluation of the necessity and proportionality of those orders in every single case, taking into account the rights of the suspect or the accused person.
