# Recital 25

This Regulation should also apply to proceedings initiated by an issuing authority to locate a convicted person that has absconded from justice, in order to execute a custodial sentence or a detention order following criminal proceedings. However, where the custodial sentence or detention order was imposed by a decision rendered in absentia it should not be possible to issue a European Production Order or a European Preservation Order, as the national law of the Member States on judicial decisions rendered in absentia varies considerably throughout the Union.
